The Company plans to seek a waiver to draw up to an additional $51.5 million under its senior secured credit facility with ACP Post Oak Credit II LLC, as administrative agent and collateral agent, and Atlas Credit Partners, LLC, as lender.\n4. Includes $110 million of 10-year subordinated convertible notes with 5.50% interest (which may be paid in kind), with a conversion price of $5.75 per share, and $45 million of non-dilutive commercial payments.",
