Under the OPSC, States must criminalize the offering, obtaining, procuring, or providing of a child for child prostitution and related forms of exploitation, and again may impose liability on legal persons under domestic law. If a private entity knowingly hosted or facilitated arrangements involving minors in exploitative circumstances, these frameworks could be engaged, subject to the facts established and the applicable domestic implementing legislation. The Palermo Protocol (Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children) is central here. It defines trafficking in persons to include the recruitment, transportation, transfer, harboring, or receipt of a child for the purpose of exploitation, and for children no proof of force, coercion, or deception is required. Exploitation includes, at minimum, the exploitation of the prostitution of others and other forms of sexual exploitation. Accordingly, where a private entity knowingly receives, harbors, or facilitates the movement of minors for exploitative purposes, such conduct could potentially fall within the factual scope of child trafficking, with any resulting liability generally arising under national laws implementing the Protocol.",

Where personnel of a private entity were alleged to have ignored apparent indicators of child sexual exploitation, or to have facilitated suspicious arrangements, this framework would also be relevant to the host State’s duties of prevention, investigation, and punishment.",
