      "text": "If children originating from Russian-occupied areas of Ukraine were accommodated in Russia on the basis that they were \"orphans,\" despite reported indications that their parents remained in Ukrainian government-controlled territory, the first framework that may potentially be engaged is IHL, more specifically, the law of occupation. Under Article 49 of the Fourth Geneva Convention, individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not, are prohibited, regardless of their motive. Article 50 further requires the occupying power to facilitate the proper identification of children and the registration of their parentage. Article 78 of Additional Protocol I permits evacuation of children from occupied territory only in narrow circumstances and requires, where parents or legal guardians can be found, their written consent. If the facts show that children were removed from occupied territory, classified as \"orphans,\" and housed in transit toward adoption, such conduct could form part of, facilitate, or conceal conduct potentially inconsistent with these rules. Private actors are not themselves bound by IHL in the same way States and parties to the conflict are. However, if the alleged conduct occurred, the respective private actor's services could have been used to facilitate, enable, conceal, or profit from the aforementioned conduct that IHL prohibits.",
