The software used must be accessible to an independent third party via an API to assess for “accuracy and unfair performance differences” across characteristics like race or gender. If unfair performance is found “the provider must develop and implement a plan to mitigate the identified performance differences within ninety days of receipt of such results”. The law also requires training and public reporting around usage of facial recognition. State Senator Joe Nguyen, who is a senior program manager at Microsoft, had sponsored the legislation.",
